Town of LaSalle By-law

By-law No: 3964

Description: A By-law to provide for the registration of dogs in the Township and the collection of a license fee from the owners thereof, and to fix a date for securing of dog tags and to prohibit dogs from running at large.

Date Passed: May 25, 1982

Whereas the Corporation of the Township of Sandwich West is authorized to pass a By-law under the provisions of The Dog Licensing and Live Stock and Poultry Protection Act, R.S.O. 1980, Chapter 123 and amendments thereto, to license and require the registration of dogs and impose license fees on the owners of them; and to prohibit or regulate the running at large of dogs to provide for seizing, impounding, killing or selling dogs found running at large.

AND WHEREAS it is deemed advisable to enact such a By-law.

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF SANDWICH WEST ENACTS AS FOLLOWS:

1.

In this By-law:
 

 

"ANIMAL CONTROL OFFICER" means a person appointed by the Council of the Township for the purpose of seizing and impounding dogs found running at large.
 

 

"DOG" means any dog, male or female.
 

 

"HUMAN SOCIETY" means the Essex County Humane Society, being a branch of the Ontario Society for the Prevention of Cruelty to Animals, incorporated by an Act of the Legislative Assembly of the Province of Ontario as 9 Geo. V., Chapter 124 (1919).
 

 

"KENNEL" means an establishment where dogs are bred, raised, trained or boarded.
 

 

"OWNER" means any person who possesses or harbours a dog.
 

 

"POUNDKEEPER" means a person appointed or employed by the Council of the Township to shelter and dispose of dogs delivered to him.
 

 

"PURE BRED" means registered or eligible for registration in the register of The Canadian Kennel Club, Incorporated.
 

 

"TOWNSHIP" means the Corporation of the Township of Sandwich West.
 

2.

(1)

Every owner of a dog shall register same and procure a dog tag on or before the 28th day or March in each year in the manner set forth hereunder.
 

 

(2)

The license fee for the registration of dogs shall be as prescribed in Schedule 1 to this By-law and shall be payable to the Treasurer of the Township.  Upon payment of the license fee, the Treasurer shall issue to each owner:
 

 

 

(i) A receipt acknowledging registration of the dog and payment of the fee.

(ii) A metal or fibre dog tag bearing a serial number.
 

 

(3)

The Clerk-Treasurer shall keep a record of the serial number for each dog tag issued, and such record will show the name and address of the owner of the dog for which the tag was issued.
 

 

(4)

The owner of a kennel of dogs that are pure-bred shall pay a fee of twenty-five ($25.00) dollars in lieu of the fees prescribed in Schedule 1 to this By-law   Upon payment of such fee, he shall receive a receipt therefor and a dog tag for each dog belonging to him, in the manner prescribed above.
 

 

(5)

Every person who becomes the owner of a dog after the 1st day of May in each year shall register the same and pay the license fee in accordance with sub-section (2) above within fifteen days of acquiring or otherwise becoming the owner thereof.
 

 

(6)

A license fee is not required for any young born to a dog until such young has attained the age of three months.
 

3.

Every owner of a dog shall securely fix the dog tag on the dog for which the tag was issued, and on no other dog, and the said tag must be worn at all times by the dog until it is renewed or replaced.
 

4.

(1)

The Council shall provide for the appointment of an Animal Control Officer and a Poundkeeper and shall provide for the terms of such appointment.
 

 

(2)

The Council, instead of appointing an Animal Control Officer and/or a Poundkeeper as herein provided, may enter into an agreement with the Humane Society and upon such terms as may be deemed advisable, under which the Inspector of the Human Society for the time being shall be the Animal Control Officer and/or the Poundkeeper; and the Humane Society shall place at the disposal of the Township its animal hostel for use as the Township dog pound and shall, through its inspector, receive and assume responsibility for the feeding, care and disposal off all dogs brought to the said hostel, and the inspector and Humane Society may be paid such remuneration as may be determined by Council.
 

5.

(1)

The running at large of any dog in the Township is hereby prohibited.  For the purpose of this section, a dog shall be deemed to be running at large when found in any place other than the premises of the owner of the dog and not under the control of any person.
 

 

(2)

 It shall be the duty of the Poundkeeper to provide suitable quarters and steel cages as may be approved by the Council of the Township, so as to keep in a humane manner all dogs may be brought to him.
 

 

(3)

The Poundkeeper shall, in a book furnished to him by the Clerk of the Township, keep an accurate account of all dogs placed in the pound, including the date of receipt, times of feeding and watering, manner of final disposal, the methods.
 

4.

(1)

The Council shall provide the appointment of an Animal Control Officer and a Poundkeeper and shall provide for the terms of such appointment.
 

 

(2)

The Council, instead of appointing an Animal Control Officer and/or a Poundkeeper as herein provided, may enter into an agreement with the Humane Society and upon such terms may be deemed advisable, under which the inspector of the Humane Society for the time being shall be the Animal Control Officer and/or the Poundkeeper; and the Humane Society shall place at the disposal of the Township its animal hostel for use as the Township dog pound and shall, through its inspector, receive and assume responsibility for the feeding, care and disposal of all dogs brought to the said hostel, and the inspector and Humane Society may be paid such remuneration as may be determined by Council.
 

5.

(1)

The running at large of any dog in the Township is hereby prohibited.  For the purpose of this section, a dog shall be deemed to be running at large when found in any place other than the premises of the owner of the dog and not under the control of any person.
 

 

(2)

It shall be the duty of the Poundkeeper to provide suitable quarters and steel cages as may be approved by the Council of the Township, so as to keep in a humane manner all dogs that may be brought to him.
 

 

(3)

The Poundkeeper shall, in a book furnished to him by the Clerk of the Township, keep an accurate account of all dogs placed in the pound, including the date of receipt, times of feeding and watering, manner of final disposal, the methods of destruction of the same, amounts received by way of redemption fees and sales, the names and addresses of purchasers of dogs and any other particulars which the said Clerk may deem advisable.  The Pound shall be opened at the hour of 11:30 o'clock in the morning of everyday, Monday to Friday, and shall not be closed before 3:30 o'clock in the afternoon.
 

 

(4)

Every dog delivered to the Poundkeeper by the Animal Control Officer shall be confined in the pound for seventy-two (72) hours, and at the end of such period may, if not redeemed by the owner or sold in the manner hereinafter provided, be destroyed by the Poundkeeper in such a manner as the Inspector of the Humane Society shall prescribe, and the carcass shall be disposed to the satisfaction of the Medical Officer of Health for the Township.
 

 

(5)

The owner of any dog impounded under the provisions of this By-law may redeem the said dog within seventy-two (72) hours of its delivery to the Poundkeeper by paying to the said Poundkeeper the sum of five ($5.00) dollars plus three ($3.00) dollars for each day, or part thereof, that the dog was impounded by the Poundkeeper.
 

 

(6)

Any dog that is not redeemed by the owner may be sold by the Poundkeeper for not less than five ($5.00) dollars.
 

 

(7)

Before releasing any dog, the Poundkeeper shall satisfy himself that the necessary license fee has been paid.
 

7.

Every owner who fails  to comply with any of the provisions of Sections 2 and 3 is guilty of an offence and, on summary conviction, is liable to a fine of not less than fifty ($50.00) dollars and not more than three hundred ($300.00) dollars.
 

8.

(1)

Every owner of a dog who allows it to run at large, contrary to Section 5(1) of this By-law, is guilty of an offence and on summary conviction is liable to a fine of not more than fifty ($50.00) dollars.
 

 

(2)

The owner of any dog found running at large may make a voluntary payment of the penalty out of Court under the Provincial Offences Act, 1979.
 

9.

By-law number 3935, finally passed on the 15ht day of December, A.D., 1981, is hereby repealed.

This By-law shall come into force and take effect on the date of the final passing thereof.
