Description: A By-law to prohibit vicious
dogs.
Date Passed: March 27th, 1984
WHEREAS paragraph 1 of Section 210 of the
Municipal Act, R.S.O. 1980, Chapter 302 provides that by-laws may be
passed for prohibiting or regulating animals or classes thereof;
AND WHEREAS it is deemed expedient to prohibit
the class of "vicious dogs" within the Township and to provide for
their capture as set out herein;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF
THE TOWNSHIP OF SANDWICH WEST HEREBY ENACTS AS FOLLOWS:

In this By-law:
(a) "By-law enforcement officer" shall mean a
provincial offences officer as defined in subsection (1)(i) of section 1 of the Provincial Offences Act , R.S.O. 1980, Chapter 400, as amended;
(b) "police work dog" shall mean a dog trained for working in law enforcement for and kept or owned by the
Township of Sandwich West Police Force;
(c) "Pound" shall mean the Essex County Dog Pound (No. 3);
(d) "Poundkeepern shall mean the keeper of the Essex County Dog Pound (No. 3) as
appointed from time to time;
(e) "Township" shall mean the
Township of Sandwich West;
(f) "vicious dog" shall
mean a dog, other than a police work dog, that :
(i)
has bitten or attacked any person causing physical injury to that person.
(ii) has bitten or attacked any animal causing physical injury to that
animal;

No person shall possess, keep, own or harbour
a vicious dog with in the Township;

A By-law enforcement officer may capture
and take into custody any vicious dog that is found with in the
Township contrary to Section 2 of this By-law;

(1) Every dog captured
pursuant to the provisions of Section 3 herein
shall be delivered by the By-law enforcement officer to the Pound.
(2) The poundkeeper, upon delivery to him of any vicious dog,
shall impound the said dog in accordance wit h the rules and
regulations regarding the operation of the Pound;

Every person who contravenes any provision
of this By-law is guilty of an offence and on conviction is
liable to a fine of not more than $2,000.00, exclusive of costs,
which is recoverable under the provisions of the Provincial
Offences Act;

This By-law shall come into force and take effect on the final
passing thererof .
