Town of LaSalle By-law

Description: A By-Law to regulate the
number of dogs that may be kept by any person within the Town of
LaSalle.
Date Passed: May 22, 2001
WHEREAS by virtue of Section 210(1) of the
Municipal Act, R.S.O. 1990 c. M.45 as amended, the Corporation of
the Town of LaSalle is authorized to pass a By-law regulating the
number of animals or any class thereof that may be kept by any
person within the limits of the Town of LaSalle;
AND WHEREAS it is deemed advisable to enact
such a By-Law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF
THE TOWN OF LASALLE HEREBY ENACTS AS FOLLOWS:

1. |
No person or persons shall keep or
permit to be kept any more than 3 dogs in or about any
dwelling unit within the Town of LaSalle.

2. |
(1) |
This By-law shall not apply to any
person who was lawfully keeping more than 3 dogs in or
about a dwelling unit on the date of the passing of this
By-law, so long as the said person continues to keep
only, and not more than the same dogs, the said person
had been lawfully keeping on the date of the passing of
this by-law.

(2) |
In the event a person to whom
subsection (1) herein applies suffers a loss of one or
more of the dogs being lawfully kept on the date of the
passing of this By-law, either by death, sale, loss or
other means, the said person shall not be permitted to
replace or substitute the said dog so lost with any
other dog if the replacement or substitution of the said
dog so lost will bring the total number of dogs in or
about that dwelling unit to more than 3 as prohibited by
this By-law.

3. |
This By-law shall not apply to the
owner or operator of a dwelling unit used as a kennel
for dogs, which kennel has been registered with the
Canadian Kennel Club Incorporated and for which a kennel
license has been issued by the Corporation.

4. |
Any person who contravenes any of
the provisions of this By-law is guilty of an offence,
and upon conviction is liable to a fine of not more than
$5,000.00 for each offence committed, which fine is
recoverable pursuant to the provisions of the Provincial
Offences Act, R.S.O. 1990, c. P.33, as amended.

This By-law shall come into force
and take effect on the final passing thereof. |
