Town of LaSalle By-law

Description:  A By-law to regulate the growing of noxious weeds on vacant parcels of land within the Town of LaSalle.

Date Passed:  June 10, 2003

WHEREAS Section 130 of the Municipal Act 2001, S.O. 2001, Chapter 25 as amended, authorizes a municipality to regulate matters not specifically provided for by that Act or any other Act for purposes related to the health, safety and well being of its inhabitants;

AND WHEREAS by virtue of the existence of many old registered plans of subdivision within the Town of LaSalle, there exist a number of parcels of vacant land where the property owners permit noxious weeds to grow without regard to the affects of these weeds on the health and well-being of the inhabitants in the area;

AND WHEREAS despite the fact that many of these parcels of vacant land are far enough away from any land used for agricultural or horticultural purposes that the noxious weeds thereon do not interfere with those uses, the health and well-being of the inhabitants in the area of these parcels of vacant land are negatively affected by the unfettered growth of these noxious weeds;

AND WHEREAS Section 427 of the Municipal Act, 2001 authorizes a municipality to enter upon land to do a matter or thing on behalf of the property owner under certain terms and conditions;

AND WHEREAS it is deemed expedient by the Corporation to regulate the growth of noxious weeds on vacant parcels of land within the Town of LaSalle where the health and well-being of the inhabitants of the Town have been, are being or may be negatively affected;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF LASALLE HEREBY ENACTS AS FOLLOWS:

1.

In this By-law, "noxious weeds" shall mean any plants that are designated as noxious weeds in the regulations made pursuant to the Weed Control Act, R.S.O. 1990, Chapter W.5, as amended.
 

2.

No person shall grow or permit to be grown any noxious weeds on any vacant parcel of land lying within the Town of LaSalle.
 

3.

No person shall deposit or permit to be deposited any noxious weeds on any lands where the said weeds might grow or spread.
 

4.

The provisions of Sections 2 and 3 of this By-law shall apply to any vacant parcel of land within the Town of LaSalle, despite the fact that the said parcel of land is far enough away from any land used for agricultural or horticultural purposes that it does not interfere with that use.
 

5.

Where noxious weeds are found growing on any vacant parcel of land, and it is determined by the Weed Inspector of the Corporation that the health and/or well-being of the inhabitants in the area have been, are being or may be negatively affected, the Weed Inspector may require that the noxious weeds be destroyed.
 

6.

(1)

The Weed Inspector of the Corporation shall place, in any newspaper having general circulation within the Town of LaSalle, a Notice stating that in the event any noxious weeds are found growing on any vacant parcel of land at any time during the period of June 1 to September 15 both inclusive, in any year, the Weed Inspector may cause the said noxious weeds to be destroyed.
 

 

(2)

For the purposes of subsection 1, the Weed Inspector or his or her agent may enter upon the said land at any reasonable time.
 

 

(3)

The Weed Inspector shall keep a record of all expenses incurred under Subsection 1 with respect to each parcel of land, and shall submit a statement of such expenses to the Clerk of the Corporation.
 

 

(4)

The Clerk of the Corporation shall submit to the registered owner of the said parcel of land a statement of the expenses incurred by the Corporation, together with a notice requesting payment of these expenses.
 

 

(5)

If the registered owner of the said land fails to pay the amount set out in the statement within 15-days, not including Saturdays, Sundays or holidays, after the notice was mail by pre-paid first class mail, the amount shall be paid by the Corporation out of the general funds of the municipality and the amount so paid shall be added to the tax roll of that property and collected in the same manner as taxes.
 

7.

Any person who contravenes any of the provisions of this By-law is guilty of an offence and, upon conviction, is liable to a fine of not more than $5,000.00, which fine is recoverable pursuant to the provisions of Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended.
 

8.

This By-law shall come into force and take effect on the final passing thereof.
