Town of LaSalle By-law

By-law No: 6133

Description:  A By-law to amend the Sign By-law of the Town of LaSalle, being By-law No. 6407.

Date Passed:  December 13, 2005

WHEREAS By-law 6407, being the Sign By-law of the Town of LaSalle was finally passed by Council on March 23, 2004;

AND WHEREAS it is deemed expedient to make certain amendments to the Sign By-law to regulate portable outdoor signs and to amend other sections thereof;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF LASALLE HEREBY ENACTS AS FOLLOWS:

1.

The Sign By-law of the Town of LaSalle, being By-law 6407, finally passed by Council on March 23, 2004, shall be amended by the addition of "Section 2.4" which Section shall read as follows:
 

 

2.4.

Notwithstanding any of the provisions of this By-law, all types of sign or advertising devices, save and except portable outdoor signs, that are used to identify the owner and/or use of the specific property shall be permitted on lands upon which a municipal or institutional use is located, subject to compliance with the provisions of this By-law applicable to the type of sign, size and location of sign, and the issuance of a permit for the said sign.
 

2.

The Sign By-law of the Town of LaSalle, being By-law 6407, finally passed by Council on March 23, 2004, shall be amended by the addition of "Section 4A", which Section shall-read as follows:
 

 

4A.

PORTABLE OUTDOOR SIGNS
 

 

4A.1

In this Section:

 

 

(1) "portable outdoor sign" shall mean any sign or advertising device, whether it is owned, leased, borrowed or otherwise, that is made of any material whatsoever and is not permanently affixed to the ground or to a building or structure, including a fence, which sign is designed with or without wheels so as to facilitate its movement froth place to place, including sandwich signs and any sign attached to or displayed on a vehicle, licensed or unlicensed, which vehicle is used for the purpose of advertising a business, product, service or entertainment, and shall include a banner sign made of any material whatsoever; and.
 

 

 

(2) "parcel of land" shall mean a single parcel or tract of land that is under the common ownership of one or more persons or corporations,
 

 

4A.2

No person shall erect or display or cause to be erected or displayed any portable outdoor sign in the Town that is greater than 1.8 metres in height measured from the ground to the top of the sign, or greater than 2.4 metres in width.
 

 

4A.3

No person shall erect or display or cause to be erected or displayed any portable outdoor sign in the Town unless the parcel of land upon which this sign located is zoned to permit a commercial use under the Town's Zoning By-law, as amended.
 

 

4A.4

(1) No person shall erect or display or cause to be erected or displayed more than one (1) portable outdoor signs on any parcel of land that has 60 metres or less in frontage.
 

 

 

(2) No person shall erect or display or cause to be erected or displayed more than two (2) portable outdoor signs on any parcel of land that has more than 60 metres in frontage but not more than 120 metres in frontage, which signs shall not be located closer than 6 metres to each other.
 

 

 

(3) No person shall erect or display or cause to be erected or displayed more than three (3) portable outdoor signs on any parcel of land that has more than 120 metres in frontage, which signs shall not be located closer than 6 metres to each other.
 

 

4A.5

No person shall erect or display or cause to be erected or displayed any portable outdoor sign on any parcel of land where the sign is:
 

 

 

(1) closer than 4.5 metres to a driveway or other access to any parcel of land; or
 

 

 

(2) closer than 3 meters to any other sign on any abutting parcel of land; or
 

 

 

(3) closer than 6 metres to any ground sign on the parcel of land upon which the portable outdoor sign is located.
 

 

4A.6

No person shall erect or display or cause to be erected or displayed any portable outdoor sign on:
 

 

 

(1) any road allowance or highway owned the corporation, owned by the Corporation of the County of Essex, or by the Province of Ontario; or
 

 

 

(2) on any other land owned by the Corporation; or
 

 

 

(3) on any land that is subject to an easement granted to the Corporation or to the Corporation of the County of Essex.
 

 

4A.7

No person shall erect or display or cause to be erected or displayed any portable outdoor sign on any parcel of land where the content of the said sign pertains to a business or activity that is not located or does not operate or occur on that parcel of land.
 

 

4A.8

(1) No owner of land shall erect or display or cause to be erected or displayed any portable outdoor sign on their land, whether the portable outdoor sign is owned, leased, borrowed or otherwise by the owner of the said lands, unless a permit and validation sticker or device for each sign has first been obtained by the said owner from the Clerk of the Corporation.
 

 

 

(2) An owner of land may apply for a permit and validation sticker or device for a portable outdoor sign on behalf of any business or tenant operating a business on the owner's parcel of land.
 

 

 

(3) The owner of land may, in writing, delegate to one agent the authority to make an application for a permit and validation sticker or device for a portable, outdoor sign in accordance with the provisions of this By-law.
 

 

 

(4) At such time as the owner of land has received a permit and validation sticker or device for a portable outdoor sign on behalf of a business or a tenant operating a business on the owner's parcel of land, the said owner shall not permit any person or business to advertise on the said portable outdoor sign other than the business or tenant upon who's behalf the permit and validation sticker or device were obtained.
 

 

 

(5) No more than three (3) permits in any calendar year shall be granted to the owner of any parcel of land on behalf of the same business for the use of any portable outdoor sign on that parcel of land.
 

 

 

(6) No person shall erect or display or cause to be erected or displayed any portable outdoor sign unless a validation sticker or device has been placed on such sign for the time, period for which the permit is in effect.
 

 

 

(7) A permit for a portable outdoor sign shall expire on the expiry date indicated on the said permit.
 

 

 

(8) The expiry date on a permit of a portable outdoor sign shall not be later than 30 consecutive days after the date the permit for the portable outdoor sign was issued.
 

 

4A.9

(1) No owner of any portable outdoor sign shall permit any of his, hers or its signs, to be erected or placed within the Town unless that owner has a license to operate such a business in the Town.
 

 

 

(2) Notwithstanding the provisions of subsection (1) herein, any owner of a portable outdoor sign who erects or displays the said sign on his, hers or its property shall not be required to obtain a business license from the Town.
 

 

4A.10

Prior to an issuance of a permit for any portable outdoor sign, an application shall be submitted to the Clerk of the Corporation in the prescribed form, accompanied by the following:
 

 

 

(a) all plans, drawings and specifications, including all information and construction details as prescribed on the application for the sign or signs proposed to be erected, displayed, altered or repaired;
 

 

 

(b) evidence of the approval of the Province of Ontario or the County of Essex, if applicable;
 

 

 

(c) the fees payable as outline in Schedule "B" attached hereto, which Schedule shall form a part of this By-law.

The Sign By-law of the Town of LaSalle, being By-law 6407, finally passed by Council on March 23, 2004, shall be amended by the deletion of Section 4.2, and by the substitution of the following Section therefor:
 

 

4.2

No person shall erect or display or cause to be erected or displayed anywhere within the Town any ground sign:

 

 

(a) in any side yard on any lot as defined in the Corporation's Zoning By-law;
 

 

 

(b) in any Residential Zone as designated in the Corporation's Zoning By-law, save and except for signs that are for the purposes of identification only on lands upon which multi-unit buildings containing three or more units, residential care facilities and other similar buildings are located;
 

 

 

(c) within 4.5 m. of an intersection of any street or' of any vehicle access onto any lot; or (d) within 4.5 m. of any other ground sign on any abutting lot.
 

 4.

The Sign By-law of the Town of LaSalle, being By-law 6407, finally passed by Council on March 23, 2004, shall be amended by the addition of Section 5.3, which Section shall read as follows:
 

 

5.3

(a) Nothing in this By-law shall be deemed to prevent any person from erecting or displaying or causing to be erected or displayed any sign for an existing business that is a legal non-conforming use and is being operated on lands in a Residential Zone as designated in the Corporation's Zoning By-law.
 

 

 

(b) Any person who wishes 'to erect any sign for a legal nonconforming business as referred to in subsection (a) herein shall be required to comply with all of the provisions of this By-law, as amended.
 

5.

The Sign By-law of the Town of LaSalle, being By-law 6407, finally passed by Council on March 23, 2004, shall be amended by the deletion of Subsection 9.1 (g), and by the substitution of the following subsection therefor:
 

 

 

9.1 (g) Monuments or other markers found in cemeteries;
 

6.

This By-law shall take effect on the final passing thereof.
