Description: A By-law to regulate the
number of cats that may be kept by any person within the Town of
LaSalle..

WHEREAS pursuant to the provisions of the
Municipal Act, S.O. 2001, c.25 the Corporation of the Town of
LaSalle is authorized to pass a By-law regulating the number of
animals or any class thereof that may be kept by any person within
the limits of the Town of LaSalle.
AND WHEREAS it is deemed advisable to enact
such a By-Law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF
THE TOWN OF LASALLE HEREBY ENACTS AS FOLLOWS:

1. |
In this By-law, “dwelling unit”
shall mean a separate set of living quarters containing
at least one room and separate kitchen and sanitary
convenience, with a private entrance from outside or
from a common hallway or stairway inside.

2. |
No person or persons shall keep or
permit to be kept any more than 4 cats in or about any
dwelling unit within the Town of LaSalle.

3. |
(1) |
Any person who owns or is keeping
more than 4 cats in or about a dwelling unit on the date
of the passing of this By-law shall file with the
Corporation on or before the 31st day of July, 2006,
such documentation as may be required by the Clerk of
the Corporation, which documentation shall be deemed to
be evidence that the said person was lawfully keeping
more than 4 cats in or about that dwelling unit on the
date of the passing of this By-law.

(2) |
This By-Law shall not apply to any
person who has filed the necessary documentation
referred to in subsection (1) herein with the Clerk of
the Corporation, so long as the said person continues to
keep only, and not more than, the same cats the said
person had been lawfully keeping on the date of the
passing of this By-Law.

(3) |
In the event a person to whom
subsections (1) and (2) herein apply suffers a loss of
one or more of the cats being lawfully kept on the date
of the passing of this By-Law, either by death, sale,
loss or other means, the said person shall not be
permitted to replace or substitute the said cat so lost
with any other cat if the replacement or substitution of
the said cat so lost will bring the total number of cats
in or about that dwelling unit to more than 4 as
prohibited by this By-Law.

4. |
In the event any cat in any
dwelling unit gives birth to a litter of kittens, no
person who is lawfully keeping the mother cat shall
retain possession of any of the kittens beyond 12 weeks
after the date of their birth where the possession of
such kitten(s) will increase the number of cats legally
permitted to be kept by that person.

5. |
Any person who contravenes any of
the provisions of this By-Law is guilty of an offence,
and upon conviction is liable to a fine of not more than
$5,000.00 for each offence committed, which fine is
recoverable pursuant to the provisions of the Provincial
Offences Act, R.S.O. 2001, c. P.33, as amended.

6. |
This By-law shall come into full
force and effect upon the final passing thereof. |
