Description: A By-law to regulate the outdoor parking or storage of recreational, commercial and other vehicles in Residential Zones in the Town of LaSalle

WHEREAS Sections 8 and 11 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended authorizes the Corporation to pass by-laws to govern the affairs of the municipality as it considers appropriate to respond to municipal issues;
AND WHEREAS the Corporation deems it expedient to regulate the outdoor parking or storage of recreational, commercial and other vehicles in the residential areas of the municipality;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF LASALLE HEREBY ENACTS AS FOLLOWS:
DEFINITIONS
| 1. |
In this By-law: |
| |
1) |
"boat" shall mean any water vessel propelled by oars, sail, an engine or paddles;
|
| |
2) |
"commercial vehicle" shall mean a motor vehicle having permanently attached thereto a truck or delivery body, and includes ambulances, hearses, fire apparatus, buses and tractors used for hauling purposes on highways;
|
| |
3) |
"highway" shall include a common and public highway, street, avenue, parkway, driveway, square, place, bridge, or any part thereof which is intended for or used by the general public for the passage of vehicles, and includes the area between the lateral property lines thereof;

4) |
"recreational vehicle" shall mean a vehicle which is intended to provide sleeping and other facilities for short periods of time, while travelling or vacationing, designed to be either towed behind a motor vehicle or is self propelled, and includes such vehicles commonly known as travel trailers, camper trailers, pick-up coaches, motorized campers, motorized homes or other similar vehicles;

5) |
"Residential Zone" shall mean any residential zone as set out in the Zoning By-law;
|
| |
6) |
"small commercial vehicle" shall mean a motor vehicle having dimensions not greater than 2.4 metres (7.9 ft) of width, 2.4 metres (7.9 ft) of height above ground, nor 6 metres (20 ft) of length, used for commercial purposes.

7) |
"utility trailer" shall mean a trailer that is intended to be drawn by another vehicle and is used for the purpose of transporting goods or materials of any kind; |
| |
8) |
'yard" shall mean any yard as defined in the Zoning By-law, and shall include a front yard, rear yard and side yard; and
|
| |
9) |
"Zoning By-law" shall mean The Town of LaSalle Comprehensive Zoning By-law, as amended from time to time.
|
| 2. |
No person shall park or store or cause to be parked or stored more than one recreational vehicle, or one boat, or one utility trailer in any yard of any property located in a Residential Zone.
|
| 3. |
No person shall park or store or cause to be parked or stored more than two motorized snow vehicles, personal watercraft, all-terrain vehicles or any other similar vehicles, or any combination thereof, in any yard of any property located in a Residential Zone.
|
| 4. |
No person shall park or store or cause to be parked or stored any recreational vehicle, boat, utility trailer, motorized snow vehicle, personal watercraft, all-terrain vehicle or other similar vehicle closer than five (5) feet to any property line of any property located in a Residential Zone.

| 5. |
No person shall park or store or cause to be parked or stored any recreational vehicle, boat, utility trailer, motorized snow vehicle, personal watercraft, all-terrain vehicle or other similar vehicle in any front yard of any property located in a Residential Zone unless the said recreational vehicle, boat, utility trailer, motorized snow vehicle, personal watercraft, all-terrain vehicle or other similar vehicle is parked or stored on a driveway that has been constructed on the said property.

| 6. |
No person shall park or store or cause to be parked or stored any recreational vehicle or boat in any yard of any property located in a Residential Zone unless the said person is both the registered owner of the said property and the owner of the said recreational vehicle or boat, or the owner of the recreational vehicle or boat is a full time resident of the home located on the subject property.

| 7. |
The provisions of this By-law shall not apply to any person who has parked a recreational vehicle on a property located in a Residential Zone for the purposes of either loading or unloading goods or materials from the said recreational vehicle on the condition that the recreational vehicle does not remain on the subject property for any single period longer than four (4) consecutive days.

| 8. |
No person shall park or store or cause to be parked or stored any recreational vehicle, boat, utility trailer, personal watercraft, all-terrain vehicle or other similar vehicle in any front yard of any property in a Residential Zone for the period from November 1 to April 30.
|
| 9. |
No person shall park or store or cause to be parked or stored any motorized snow vehicle or any other similar snow vehicle in any front yard of any property in a Residential Zone for the period from May 1 to October 31.
|
| 10. |
No person shall park or store or cause to be parked or stored any recreational vehicle, boat, utility trailer, motorized snow vehicle, personal watercraft, all-terrain vehicle or other similar vehicle on any street or highway in a Residential Zone.
|
| 11. |
No person shall park or store or cause to be parked or stored any commercial vehicle on any property located in a Residential Zone except in accordance with the provisions of this By-law.
|
| 12. |
No person shall park or store or cause to be parked or stored a small commercial vehicle on any property located in a Residential Zone unless:
|
| |
1) |
the owner or full time occupant of the residential property is also the owner or operator of the small commercial vehicle; and
|
| |
2) |
the small commercial vehicle is located on a driveway that has been constructed on the said property, or it is fully contained within a garage located on the subject property; and
|
| |
3) |
any small commercial vehicle that is parked or stored on a driveway on the subject property is no closer than 5 feet to any property line of the said property; and
|
| |
4) |
the small commercial vehicle is not used for the purposes of any business that is being conducted on the residential property contrary to the provisions of the Zoning By-law; and
|
| |
5) |
any goods, material, or contents stored on or in the small commercial vehicle are not exposed to or are not in the general view of any other person who is not an owner or occupant of the subject property; and
|
| |
6) |
the small commercial vehicle has a current licence plate.
|
| 13. |
No person shall park or store or cause to be parked or stored any commercial vehicle or small commercial vehicle on any street or highway in any Residential Zone.
|
| 14. |
Nothing in this By-law shall be deemed to prohibit the parking of any small commercial vehicle on any property in a Residential Zone where the owner or operator of the small commercial vehicle is providing a service to the owner or occupant of the residential property for a temporary period of time.

| 15 |
Any person who violates any provision of this By-law is guilty of an offence and shall, upon conviction, be liable to pay a fine of not more that $5,000.00, exclusive of costs, for each offence, which is recoverable under the Provincial Offences Act, R.S.O. 1990, c. P. 33, as amended

| 16 |
This By-law shall come into force and take effect on the 1st day May, 2010. |
